These terms of service (“Agreement”) are a legal agreement between you (“you”, “your”, or “Customer”) and Napiers Herbals Ltd (“we” or “Napiers”), a subsidiary of Napiers Group 1860 Ltd, who operates the membership service known as Napiers Beard Club. (“Napiers Beard Club”). Napiers is the owner and operator of the www.napiersbeardclub.com website (the “Site”). This agreement states the terms and conditions that govern your use of the Site and the products sold on it and memberships sold to it. This agreement is established by using the Site. If you do not agree with this, then you should not access the Site or buy any products or services from it.
Before signing up for a membership, you should be at least 18 years old. If you are under 18 years old by using this Site you are confirming that you have obtained your parents or legal guardian’s permission to enter into this agreement.
Customers agree to provide accurate, current, and complete information as required for the purchase of the Products and Memberships and to update that information as soon as possible after any information provided changes. Napiers reserves the right to block further sales to Customers who provide false, inaccurate or incomplete data. Customer acknowledges that Napiers uses a third party payment processing service to processing orders and bill fees to your credit card.
SITE USE and TERMS OF SALE
You will be required to register and create an account by providing your email address and a password. You are responsible for maintaining the confidentiality of your password, and you are responsible for all activities that occur using your email and password. You agree not to share your password, let anyone else access your account or do anything else that might jeopardise the security of your passwords or account. You agree to notify Napiers Beard Club if there is any unauthorised use of your password or account on this Site or if you know of any other breach of security in relation to this Site.
Napiers Beard Club may add to, change or remove any part of the Site, including, without limitation, any Content (as defined below) therein, at any time without prior notice to you.
Sales of Products and Memberships will be made to end consumers only. Wholesale orders should be addressed to firstname.lastname@example.org.
Napiers Beard Cub reserves the right to change the prices and fees for Products and Memberships at any time, and does not provide price protection or refunds in the event of promotions or price decreases.
Napiers Beard Club will issue a full refund (except any shipping or handling costs). Returned products should be in their original unopened and unused packaging.
Napiers Beard Club offers a monthly membership. Your membership is billed month-to-month and is automatically renewed.
You can cancel at any time. Napiers Beard Club requires a reasonable amount of time to process your Membership cancellation request. If you cancel your Membership, you will enjoy your Membership benefits until the end of the then-current Membership term, and your Membership benefits will expire at the end of the then-current Membership term for which you have paid. You will not be eligible for a pro-rated refund of any portion of the Membership fees paid for any unused days of the then-current Membership term. No early termination fees or any other fees of any kind are applied when cancelling a Membership during the membership term.

You hereby acknowledge and agree that Napiers owns all legal right, title and interest in and to the Site and Content, including, without limitation, any and all intellectual property and other proprietary rights. Trademarks, names and logos on this Site are the property of their respective owners. Unless otherwise specified in this Agreement, all information and screens appearing on this Site, including Content, site design, text, graphics, logos, images and icons are the property of Napiers Group 1860 Ltd.
HOW THE CONTRACT IS FORMED BETWEEN YOU AND US
After placing an order on our standard order form, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy Products by subscribing to a Service. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been dispatched (Dispatch Confirmation). The contract between us (Contract) will only be formed when we send you the Dispatch Confirmation.
The Contract will relate only to those Products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Products has been confirmed in a separate Dispatch Confirmation.
The subscription plan to our Services consist of an initial charge and then followed by recurring period charges as agreed to by you. By entering into this Agreement, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to deactivation. napiersbeardclub.com may submit periodic charges (e.g., monthly) without further authorisation from you, until you provide prior notice that you have terminated this authorisation or wish to change your payment method. Such notice will not affect charges submitted before napiersbeardclub.com reasonably could act. To terminate your authorisation or change your payment method email firstname.lastname@example.org.
By subscribing to napiersbeardclub.com you are agreeing to pay recurring periodic subscriptions for an indefinite time until deactivated by you or us, on the subscription terms set out in the application form you have completed, subject to variation in accordance with 1.5 below. You can deactivate your subscription at any time within the deactivation deadline. You will not be charged for any deactivation. You can re-subscribe at any time following your deactivation, but we reserve the right not to permit re-subscription where we have previously elected to terminate a subscription by you.
Cancelling your subscription is easy. You just need to go to your account area and follow these steps (This must be arranged no later than 48 hours before the scheduled dispatch of your delivery):
1. Log in to your account on the napiersbeardclub.com website
2. Under My Subscriptions click on ‘View’ for your pending order
3. Click the ‘Cancel’ option to terminate your subscription
4. Follow the steps to deactivate
Napiers Beard Club is a membership service operated by Napiers Herbals Ltd. Napiers Beard Club and Napiers Herbals Ltd value our customer’s privacy. Napiers Beard Club is a service delivered via the internet and we are committed to ensuring our site is absolutely secure for you to use and take great care to protect your personal information.
When you become a member, we need to collect information about you in order to deliver products, fulfil orders, and send you relevant administrative, account or marketing communications linked to your subscription or purchase. By using www.napiersbeardclub.com and becoming a member, you agree that your personal information will be handled by us.
What information do we hold on you?
We collect details from you when you request a product, service, offers or news from us from our website, emails, telephone conversations, social media exchanges, texts and other written and verbal communication.
